Powers and functions

The powers and functions of the Council to perform the functions set out in section 28 of the Labour Relations Act 66 of 1995 as amended as well as Clause 3 of the NBCCI Constitution, which are summarised as follows:

  • To conclude collective agreements;
  • To enforce those collective agreements;
  • To prevent and resolve labour disputes;
  • To perform the dispute resolution functions referred to in section 51;
  • To administer funds to be used for resolving disputes, collective bargaining and general administration of the Council;
  • To promote and establish training and education schemes;
  • To establish and administer funds or any similar schemes for the benefit of one or more of the parties to the bargaining council or their members; (provident or pension, medical aid, sick pay, holiday, unemployment schemes etc.)
  • To develop proposals on policy and legislation that may affect the sector or industry;
  • To determine by collective agreement the matters which may not be an issue in dispute for the purposes of a strike or lock-out at the workplace
  • To provide industrial support services within the industry.
  • To exercise any other power and function that may be necessary or desired to achieve the objectives of the Council.
